By accessing or using any part of PingerPro's Services, you agree to be bound by these Terms, including our Privacy Policy and any future updates. Continued use after changes means you accept the updated Terms. If you do not accept all Terms, do not use the Services.

2. Modifications

PingerPro reserves the right to modify these Terms at any time. We recommend reviewing them regularly. Your continued use of the Services after changes indicates acceptance of the updated Terms.

3. Account Responsibilities

You are responsible for securing your account credentials (email, password, API keys) and for all activities under your account. Notify us immediately of any unauthorized use. Misleading, unlawful, or harmful use is prohibited, and PingerPro may remove content or disable accounts at its discretion.

4. User Obligations

By using the Services, you agree to:

• Provide accurate account information.
• Avoid illegal or abusive behavior.
• Use one account only.
• Maintain security of your credentials.
• We may remove any content or terminate access for violations without refund.

5. Description of Services

PingerPro offers automated monitoring tools such as:

• Website and HTTP(S) monitoring.
• Keyword presence/absence monitoring.
• Ping and port checks.
• Heartbeat (cron job) monitoring.
• Public status pages.

6. Sponsored Subscriptions

We offer free premium plans for qualifying non-profits and open-source projects. Contact us to apply.

7. Payments, Renewals, and Refunds

• Upgrades: Optional paid features are billed monthly or annually in advance.
• Auto-Renewal: Subscriptions renew automatically unless canceled before renewal. .
• Upgrades & Downgrades: Prorated billing applies for upgrades. Downgrades take effect at the next billing cycle unless made within 24 hours of renewal.
• Refunds: Only payments made in the last 10 days are eligible for refunds.
• Credit Purchases: SMS/voice credit packs are prepaid and may auto-refill.

8. Purchase Process

Purchases are made via the user dashboard and processed by Stripe, PayPal, or 2Checkout, depending on payment method.

9. System Requirements

PingerPro works on modern browsers on any OS, including mobile platforms.

10. Intellectual Property

All content, trademarks, and IP rights remain the property of PingerPro or third-party licensors. You may not reproduce or use these without permission.

11. Advertisements

We may display advertisements in your account.

12. Termination

We may suspend or terminate your access at any time. You may terminate your account by ceasing use. Certain sections (e.g., warranties, limitations, IP) survive termination.

13. Disclaimers

PingerPro is provided “as is.” We disclaim all warranties, express or implied, including fitness for purpose and non-infringement. We do not guarantee error-free or uninterrupted service.

14. Limitation of Liability

PingerPro and its partners are not liable for:

• Indirect or incidental damages
• Data loss or corruption
• Losses exceeding what you've paid us in the past 12 months

15. User Warranties

You warrant that your use complies with these Terms, the law, and does not infringe on any third-party rights.

16. Indemnification

You agree to hold harmless PingerPro and its affiliates against any claims arising from your use of the Services or breach of these Terms.

17. No Resale or Redistribution

You may not resell or redistribute PingerPro without our explicit permission. Contact us to discuss commercial licensing.

18. Affiliate Program

Affiliate commissions are paid monthly via PayPal, subject to minimum thresholds and referral conditions. Fraud, spam, or unauthorized use may result in account termination and forfeited earnings.

19. Referral Program

Earn merchandise by referring others to PingerPro paid plans. No financial rewards are offered. Abuse (e.g., self-referrals, misleading promotions, spam) is prohibited and may result in disqualification.

21. Miscellaneous

These Terms are governed by the laws of Malta, with any disputes settled in the District Court of Sliema. You may not assign this agreement without consent. We may assign it without restriction. These Terms are the full agreement between you and PingerPro.
